SESHTA CONNECT – COMPREHENSIVE TERMS OF USE, COMMUNITY RULES, SELLER POLICY & MARKETPLACE AGREEMENT

1. LEGAL ACCEPTANCE OF TERMS

By accessing, registering, browsing, posting, selling, purchasing, advertising, or otherwise using SeshtaConnect.com (“Platform”), you legally agree to these Terms of Use, Seller Policies, Community Standards, and all applicable Indian laws.

If you do not agree, you must discontinue use immediately.

The Company may modify these Terms at any time. Continued use constitutes acceptance of updates.


2. NATURE OF PLATFORM SERVICES

Seshta Connect is a multi-functional digital intermediary platform providing infrastructure for:

• Professional networking (social media features)
• Business Pages, PBID verification & reputation systems
• Reviews & Review Replacement mechanisms
• Groups, Communities & Events
• Blogs, Reels, Videos & OTT streaming
• Jobs, Courses & Educational listings
• Offers, Promotions & Advertising
• Online Multi-Vendor E-Commerce marketplace
• Digital & physical product selling

The Platform is ONLY a technology facilitator, not a publisher, seller, employer, or guarantor.


3. INTERMEDIARY STATUS & SAFE HARBOR PROTECTION

The Platform operates as an Intermediary under Indian IT Laws.

Accordingly:

• The Company does not pre-screen all content.
• Users are solely responsible for their content and activities.
• The Company is not liable for third-party posts, transactions, disputes, or damages.
• The Company follows due diligence obligations under applicable digital laws.


4. USER ELIGIBILITY & ACCOUNT RULES

4.1 Eligibility

Users must:

• Be at least 18 years old
• Have legal capacity to enter contracts
• Provide accurate information


4.2 One-Member Policy

Each person/business may maintain only ONE account.

Prohibited:

• Fake accounts
• Multiple accounts
• Bot accounts
• Identity masking

Violation results in immediate permanent suspension.


4.3 Verification Rights

The Company may request:

• Phone verification
• Email authentication
• Government ID
• Business registration documents
• Device identification checks


5. USER-GENERATED CONTENT (UGC) RIGHTS

5.1 Ownership

Users retain ownership of content they create.

By posting, users grant the Company:

• Non-exclusive
• Worldwide
• Royalty-free
• Perpetual license

to host, display, promote, and distribute content.


5.2 AI-Generated Content Disclosure

Users must label all AI-generated or AI-modified content using the platform’s AI-Generated Tag.

Strictly prohibited:

• Deepfake impersonation
• Synthetic identity fraud
• AI manipulation intended to deceive


6. COMMUNITY STANDARDS & PROHIBITED CONTENT

Users shall NOT upload content that:

• Is defamatory, obscene, hateful, or abusive
• Contains sexual exploitation or nudity
• Invades privacy or shares personal data
• Promotes scams, fraud, or illegal activities
• Misleads consumers or spreads misinformation
• Threatens public safety or national integrity
• Impersonates individuals or businesses
• Uses AI for deceptive purposes

Emergency removal timelines:

• Non-consensual sexual content: within 2 hours of report
• Court/government flagged content: within 3 hours


7. LAW ENFORCEMENT & COMPLIANCE

The Company may:

• Preserve user data for investigations
• Share information with authorities when legally required
• Suspend accounts under official orders


8. INTELLECTUAL PROPERTY & COPYRIGHT

Users must not post copyrighted content without permission.

The Company follows a Notice-and-Takedown Policy.

Repeat infringers will be permanently banned.


9. PRIVACY & DATA SECURITY

The Platform collects and processes user data for:

• Account operation
• Transaction processing
• Platform safety
• Legal compliance

The Company uses reasonable security measures but does not guarantee absolute protection from cyber threats.


10. ADVERTISING & PROMOTIONAL CONTENT

Users may advertise subject to:

• Truthful representation
• Clear labeling as “Sponsored”
• Compliance with consumer laws

Prohibited advertisements include:

• Financial scams
• Fake employment schemes
• Illegal products/services

The Company may remove ads without notice.


11. DIGITAL IDENTITY – PBID POLICY

PBID (Pages Business ID) provides verified identity status.

Misuse, falsification, or fraudulent documentation may result in:

• Immediate revocation
• Permanent ban
• Legal reporting


12. REVIEW & REPUTATION SYSTEM POLICY

Reviews must be genuine and based on real experience.

The Company may remove or replace reviews that are:

• Fake or manipulated
• Defamatory or abusive
• Conflict-of-interest based

The Company holds final moderation authority.


13. OTT, MEDIA & DIGITAL CONTENT TERMS

For OTT/paid media:

• Access is limited to license period
• Downloading, piracy, or redistribution is prohibited
• Refunds for digital content are not guaranteed once accessed


14. MARKETPLACE & SELLER POLICY

14.1 Platform Role

The Company acts only as a facilitator and escrow operator.

It is not responsible for:

• Product quality
• Seller performance
• Delivery delays


14.2 Seller Eligibility

Sellers must:

• Have legal rights to sell products/services
• Comply with tax laws
• Provide accurate descriptions


14.3 Commission & Fees

Platform charges 10% commission per successful transaction.

Fees cover:

• Payment gateway charges
• Hosting costs
• Dispute resolution services


14.4 Escrow & Payout System

Payments are held securely until completion.

Physical Goods:

Payout after delivery confirmation or 7 days post-delivery.

Digital Goods:

Payout 48 hours after download/access.

Seller receives 90% balance.


15. REFUND & DISPUTE POLICY

The Platform may mediate disputes but is not obligated to resolve them.

Refund eligibility depends on:

• Seller policy
• Evidence submitted
• Platform investigation


16. TAXATION RESPONSIBILITY

Users and sellers are solely responsible for:

• GST compliance
• Income tax reporting
• Legal invoicing


17. LIMITATION OF LIABILITY

The Company shall not be liable for:

• User disputes
• Financial losses
• Transaction failures
• Technical outages
• Data loss
• Cyber incidents

Maximum liability is limited to platform fees paid.


18. INDEMNIFICATION

Users agree to indemnify the Company against:

• Legal claims
• Damages
• Government penalties
• Third-party disputes

19. FORCE MAJEURE

The Company is not liable for service interruptions due to:

• Natural disasters
• Government restrictions
• Cyber attacks
• Infrastructure failures


20. ACCOUNT TERMINATION RIGHTS

The Company may suspend or terminate accounts at its sole discretion without prior notice.


21. GOVERNING LAW & JURISDICTION

These Terms are governed by Indian law.

All disputes shall be subject to jurisdiction of courts where the Company is registered.


22. GRIEVANCE REDRESSAL MECHANISM

In our support system

Users may submit complaints to the official grievance officer.

Response timelines will follow applicable legal requirements.


ADDITIONAL LEGAL CLAUSES

Integrated Policies

These Terms and Conditions must be read together with all other Platform policies. By accessing or using Seshtaconnect, you agree that the following policies form an integral and legally binding part of these Terms:

In the event of any conflict between these Terms and any specific policy governing a particular service, the specific policy shall prevail to the extent of such conflict.

Failure to review these policies does not exempt any user from compliance or enforcement actions.


Scope of Platform Services

Seshtaconnect operates as a multi-feature digital ecosystem that provides:

• Professional networking and social media services
• Pages, Groups, Reviews, and Review Replacement systems
• Pages Business ID (PBID) verification services
• Blogs, reels, videos, and user-generated content publishing
• Events, job listings, and courses
• Online multivendor ecommerce marketplace for digital and physical products
• OTT streaming services offering both free and paid digital content

The Platform acts solely as an intermediary facilitator and does not own, control, endorse, or guarantee any user-generated content, seller products, professional listings, or third-party services.


No Professional Advice Liability

Any reviews, opinions, professional information, listings, courses, or user-generated content available on the Platform are provided for informational purposes only.

Seshtaconnect does not verify, endorse, or guarantee the accuracy, legality, quality, safety, or effectiveness of any advice, product, service, or professional claim made by users or sellers.

Users rely on such information entirely at their own risk.


Platform Modifications

The Company reserves the right, at its sole discretion, to modify, suspend, discontinue, or restrict access to any feature, service, or functionality of the Platform at any time without prior notice or liability.


Force Majeure

The Company shall not be liable for any delay, interruption, or failure to perform its obligations due to events beyond its reasonable control, including but not limited to natural disasters, cyberattacks, internet outages, government actions, regulatory changes, war, or technical failures.


Dispute Resolution

Any disputes arising from the use of the Platform shall first be attempted to be resolved through good-faith negotiations.

If unresolved, disputes shall be settled through arbitration in accordance with the Arbitration and Conciliation Act, 1996, and the place of arbitration shall be within the jurisdiction of the Company’s registered office.

Courts at the Company’s registered office location shall have exclusive jurisdiction.


Entire Agreement

These Terms and Conditions, together with all referenced policies, constitute the complete and exclusive legal agreement between the user and the Company and supersede any prior agreements, communications, or understandings.


Account Inactivity & Termination

To maintain platform integrity and system efficiency, Seshtaconnect reserves the right to deactivate or permanently terminate user accounts that remain inactive for a continuous period of twelve (12) months or more.

“Inactive” means no login activity, content posting, transactions, or meaningful engagement during this period.

Prior to termination, the Platform may attempt to notify the registered email address. Upon termination due to inactivity, associated data, content, and access rights may be permanently removed in accordance with our data retention policies.


FINAL LEGAL DECLARATION

By using the Platform, you confirm that you:

• Understand these Terms
• Accept all policies
• Agree to comply with applicable laws
