The legal battle stems from an FIR registered by the Guwahati Crime Branch following allegations made by Khera during a press conference on April 4, 2026. Khera had claimed that Riniki Bhuyan Sarma, wife of Assam CM Himanta Biswa Sarma, held multiple foreign passports and undisclosed overseas assets.

While the Assam government argued that the documents Khera presented were "forged and doctored," the Supreme Court’s focus today shifted toward the necessity of arrest in such matters.

  • Correction of Lower Court Errors: The Supreme Court noted that the Gauhati High Court had erred by shifting the burden of proof onto the accused and wrongly referencing Section 339 of the Bharatiya Nyaya Sanhita (BNS)—an offense that was not even mentioned in the original FIR.

  • Unparliamentary Remarks: Interestingly, the court also took note of "unparliamentary remarks" made by the Assam Chief Minister against Khera, suggesting an atmosphere of intimidation.

While granting the relief, the Supreme Court has imposed specific conditions on Pawan Khera to ensure the integrity of the investigation:
